Town denies building permit for Greens at Chester home

CHESTER – The Town of Chester has denied Greens at Chester’s request for a building permit, ruling that the developer of the 431-unit project is seeking to build a home with twice the square footage it is permitted under a settlement both sides approved.
The request came Nov. 20 for what may be a model home, according to Supervisor Robert Valentine.
Building Inspector James Farr declined to approve it because, he said, it did not adhere to the specifications outlined in the agreement signed by the town and Greens at Chester following a lawsuit that concluded in 2010.
According to the town, the building permit sought by Greens at Chester was for a 50-foot-wide by 36-foot-deep structure that would result in approximately 1,800 square feet per level.
The plans showed two finished floors totaling 3,600 square feet, plus an unfinished basement that added another 1,800 square feet for a total of 5,400 square feet, not including the attic.
Depending on the “grade plane,” the building may also be considered a three-story structure, Farr said in his letter of denial to Jehuda Landau, managing member of Greens at Chester.
Farr excerpted language he said was from the agreement to make his case in the denial letter: ”(i) one-unit dwellings shall be limited to 1,700 – 2,500 square feet in a two story structure and (ii) two-unit dwellings shall be limited to 1,500 – 2,300 square feet in a two story structure.”
According to Valentine, the town and the developers disagree on what the square footage refers to.

Permits and violations
The developer of Greens at Chester has yet to act on an August directive by the state Department of Health that it seek a new water permit and retest onsite and neighboring wells to determine whether there is adequate water for the 431-unit development.
According to the state, the developer must provide a testing plan for the DOH to review prior to beginning the testing.
The DOH has not received such a plan, though the developer said it will soon be provided, Health Department spokeswoman Jill Montag said in an email Monday.
The state ordered new tests because Greens at Chester’s approvals date back to 2002.
Separately, the state Department of Environmental Conservation cited Greens at Chester for violations on Nov. 6 and Nov. 28 for turbidity in water and lack of erosion and sediment controls.
The violations are subject to fines of up to $37,000 per day. So far, fines have not been determined, according to DEC spokeswoman Wendy Rosenbach.

CHESTER — An attorney for the 431-home Greens at Chester project has asked a federal judge to reopen a lawsuit settled nine years ago to resolve a dispute between the developer and the town building inspector about how big the future homes can be.
The conflict arose in November after the developers who bought the property in 2017 applied for a permit to build a two-story model home totaling 3,600 square feet, or 5,400 square feet with the inclusion of an unfinished basement. Building inspector James Farr rejected the application, saying the original plans indicated the project’s single-family homes would be 1,700 to 2,500 square feet.
Farr also said no permits for home construction could be issued until the developer had finished installing all roads, water and sewer pipes, and other infrastructure for the entire project.
Steven Barshov, the Greens at Chester’s attorney, recently wrote to the federal judge who oversaw the previous developer’s 2009 lawsuit against the Town of Chester, asking that his clients be allowed to intervene in that case to argue that the permit denial violated the terms of the 2010 settlement.
Barshov contended the town’s interpretation of the homes’ size limit would “impose severe restrictions” and was a “ruse” to block construction. And he argued that requiring all infrastructure to be done first would impose “such large, up-front costs” that the project would be “economically nonviable.”
“We attempted to amicably resolve these matters with the Town’s officials and counsel but were rebuffed,” Bashov wrote to U.S. District Court Judge Cathy Seibel in White Plains on April 18. “It appears that the Town’s officials are boxed in by their longstanding opposition to the Project, their strident public statements in furtherance of that position, and the public pressure against the Project.”

Town Attorney Scott Bonacic didn’t respond to requests for comment.
Barshov said in a phone interview that the size restriction Farr cited in his permit denial was taken from the project’s environmental impact statement, which the previous developer completed in 1998 after 13 years of town review. He contends the size range referred to the footprint for each home, not the total living space.
The project continued to languish for years after the environmental review, prompting the lawsuit by developer Wilbur Fried, who finally got conditional final approval for the Greens at Chester in 2013. Fried sold his 110-acre property for $12.1 million in 2017 to a group of Brooklyn investors, who plan to build the homes for the Hasidic community.

Developers of proposed Hasidic housing project suing Chester, Orange officials

TOWN OF CHESTER — The Greens at Chester developers have sued town and Orange County officials for allegedly trying to thwart their 431-home project before any houses have been built in order to prevent an influx of Hasidic residents.
The 101-page complaint filed Friday in federal court in White Plaints is studded with links to video clips and a slew of statements that residents and officials made at both public and private meetings, all reflecting what attorneys argue was fervent opposition to a Hasidic settlement and discriminatory efforts to derail an approved development.
The developers, known as Greens at Chester LLC, are demanding the court reverse the town’s building-permit denials and order it to issue permits for any houses that comply with plans the town approved in 2013. They also are seeking $80 million in compensatory damages for each of eight claims, $20 million in punitive damages for four of those claims, and compensation for property they say the town effectively has taken away.
The defendants include Chester Town Supervisor Robert Valentine and his predecessor, Alex Jamieson; Orange County Executive Steve Neuhaus; town Building Inspector James Farr; and four Chester Town Board members. Valentine, Neuhaus and Farr are being sued individually in addition to in their official capacities.
Valentine said in a statement on Monday that the town “denies any accusation of bias based on religious or ethnic status,” and is ready to issue a building permit once the Greens at Chester submits an application that “meets all of the project’s approved conditions.”
Neuhaus said in an emailed response: “The project does not seek permits from the County, and the lawsuit is nothing more than a thinly veiled attempt to shake down County taxpayers and to stop me from speaking against a project that I believe is not in the best interest of the public.”
The plaintiffs bought the 117-acre development site for $12.1 million in October 2017, four years after the Chester Planning Board approved the project and before any work had started. The previous owner, Wilbur Fried, had sought to develop the property since 1985, and reached a court settlement with the town in 2010 that led to the approval of 431 homes.
Shortly after the 2017 property sale, town officials met twice with the new developers in the cafeteria and basement of Town Hall to try to influence their plans, according to the lawsuit. Attorneys say Valentine urged the plaintiffs to “create a non-Hasidic community,” and promised “expedited approval” if they switched to a commercial project that would complement the Legoland theme park being built in Goshen.
The complaint also quotes speakers from a Town Board meeting in April 2018 at which audience members denounced the Greens at Chester project for nearly three hours. Neuhaus, who lives in Chester and was its town supervisor before being elected county executive in 2013, spoke at the meeting, telling the board “we can get aggressive” and “push the developer to develop commercial.”
“I am here to pledge every resource we have in this county to work with you guys to explore all these options, and I’m telling you I’m not giving up on it,” Neuhaus said then.
The next day, the town offered the developers $20 million for their property, about $8 million more than they paid for it. After they declined, Jamieson, who was then the town supervisor, raised the offer to $30 million - a sum that attorneys said showed the town’s “great desperation to keep Hasidic Jews out of Chester.”
“Given that The Greens was planned as a ‘cluster development’ in which more than half of the acreage was already slated for preservation, the Town’s willingness to pay to maintain all of the site as open space revealed again exactly what the Town considered its problem to be - namely, the prospect of Hasidic Jews in its midst,” the complaint read.
The lawsuit also cites Jamieson’s controversial statements to the Times Herald-Record last September, in which he said the town hoped to buy undeveloped properties in Chester before Hasidic developers could do so. “The idea is to keep the Hasidic out so that they can’t control the Town Board,” Jamieson said then.
Attorneys argue Farr improperly denied building permits based on a skewed reading of how large the homes could be and an “unheard of and nonsensical” demand that the developers first install the infrastructure for all five construction phases.
They also contend the town has imposed costly and unusual requirements on the plaintiffs during the preliminary work, including having them move a road they had started building, pay for a full-time site inspector, and buy easements from neighbors to move a sewer line.
