Democrats in New York State Senate Appear Set to Reconcile

Two warring factions of Democratic lawmakers have agreed to reunite and end seven years of infighting that has helped give Republicans a foothold of power in Albany in a dramatic upheaval of New York politics, according to people familiar with the deal.

An alliance in the State Senate between Republicans and a renegade of group of Democrats known as the Independent Democratic Conference was formed during Gov. Andrew M. Cuomo’s first week in office. It had since amounted to one of the oddest political arrangements in the country — and one that had become increasingly untenable in the current political climate.

Impassioned activists have called for Democrats to unite against President Trump and to hold up New York as a bastion of liberalism. They have launched primaries against most of the breakaway Democratic lawmakers. And now Mr. Cuomo himself is facing a primary challenge, from the actress Cynthia Nixon, who has made the bipartisan alliance in Albany a focus of her attacks on governor’s progressive credentials.

The Democratic accord, which would dissolve the I.D.C., came together Tuesday over coffee and cookies at a Manhattan steakhouse.

“For the good of the party, this has to stop,” Mr. Cuomo said at the closed-door gathering, according to two people who were in the room.

Around the table sat Mr. Cuomo; the leaders of New York’s most powerful labor unions; Joseph Crowley, the top-ranked New York Democrat in the House of Representatives; and the two rival Democratic leaders of the State Senate — Andrea Stewart-Cousins, who leads the main group of Democrats, and Jeffery D. Klein, who leads the breakaway group — among others.

Mr. Cuomo asked Ms. Stewart-Cousins and Mr. Klein to reunite immediately, a faster timeline than had previously been discussed, even though the Democrats would remain in the minority in the Senate.

Under the terms outlined by Mr. Cuomo, Ms. Stewart-Cousins would become the sole Democratic leader, and Mr. Klein would become her deputy.

Mr. Klein and Ms. Stewart-Cousins shook hands, and the room erupted in applause.

They are expected to make the deal official at a news conference on Wednesday afternoon.

Skepticism abounds, and many details, including the division of staffing and budget for a unified conference, remain unresolved. The longtime chief deputy under Ms. Stewart-Cousins, Senator Michael N. Gianaris of Queens, who has clashed with Mr. Klein, is expected to remain in the leadership.

In the past, Mr. Klein and Mr. Gianaris have also run rival Democratic political operations, which now must be combined.

Still, the accord represents a watershed for fractious Democratic politics in the state and a political coup for Mr. Cuomo as he faces his most serious primary challenge. For years, Mr. Cuomo had said it was not in his power to arrange a “shotgun marriage” between Mr. Klein and Ms. Stewart-Cousins, but as a deal came together the governor was very much in the middle of it.

Ms. Nixon gave the governor no credit for the reunification deal, and her supporters called it a sham done for political expediency. “If you’ve set your own house on fire and watched it burn for eight years, finally turning on a hose doesn’t make you a hero,” Ms. Nixon said in a statement.

Zephyr Teachout, who ran against Mr. Cuomo four years ago and is now the treasurer on Ms. Nixon’s campaign, said Mr. Cuomo’s role in the reunification amounted to a “confession of his complicity of Republican control” for the last seven years.

The deal comes less than a week after lawmakers passed a $168 billion budget — a spending plan, Ms. Teachout noted, in which Ms. Stewart-Cousins had been excluded from the negotiations, including on the state’s new - harassment laws.

Ms. Nixon brought up Ms. Stewart-Cousins’ exclusion from those talks during a previously taped interview on “The Wendy Williams Show” on Wednesday.

The Manhattan steakhouse meeting was about more than just the State Senate. Jefrey Pollock, a pollster for Mr. Cuomo, gave a presentation about messaging in upcoming races, and the governor emphasized the need for Democratic allies to work together in 2018.

Other meeting attendees included Mr. Cuomo’s top aide, Melissa DeRosa; his campaign chairman, William J. Mulrow; and Christine Quinn, the vice chairwoman of the New York Democratic Party and the former New York City Council speaker.

Later on Tuesday evening, at a fund-raiser for a Democratic Senate candidate in an upcoming special election, Mr. Cuomo said that “we have achieved political clarity” in watching Republican rule from Washington, D.C., for the last year.

“The clarity is this: Everything we are for, they are against. It’s that simple,” he said. “The Democratic Party and the Republican Party are an antithesis one of the other.”

The candidates challenging I.D.C. members in primaries said they would continue on, even if the Democratic Party leadership formally opposed them.

Jessica Ramos, who is running against Senator Jose R. Peralta of Queens, said she didn’t trust the deal. “Not for a second. We’ve seen this movie before,” Ms. Ramos said.

Four years ago, Mr. Klein’s group promised to ally with the mainline Democrats but ended up not doing so.

One state senator in the mainline Democratic group, who requested anonymity to speak candidly about the fragile agreement, noted that they would proceed cautiously because “we’ve been sabotaged before.”

“Let’s accept it — but sleep with one eye open,” the senator said.

The arrangement with the G.O.P. had resulted in numerous perks for I.D.C. members, including larger staffs and offices, and lucrative committee chairmanships that came with extra cash.

But on Wednesday, the New York State comptroller’s office said it would reject thousands of dollars in stipends promised to two I.D.C. members — Diane J. Savino of Staten Island and Mr. Peralta — after it was revealed that they were being paid as Senate committee chairpeople, despite not holding those titles. (Both are vice chairs, an unpaid position.)

The rival Democratic factions had agreed last November to reunite this month, following two special elections that would bring the total number of Democrats in the 63-member chamber to 32 — the bare minimum for a majority.

But one of those senators, Simcha Felder, a Brooklyn Democrat, has continued to caucus with Republicans.

Without Mr. Felder, who recently held up the state budget for concessions on how yeshivas are overseen by the state, the new Democratic coalition would still be one vote short of a majority.

In a telephone interview on Wednesday afternoon, Mr. Felder reiterated — as he has often before — that he has no loyalty to either party, but rather is looking for the best deal for his district, which includes a large population of Orthodox Jews.

“I don’t feel obligated to remain with the Republicans, or obligated to join the Democrats,” Mr. Felder said. “I’m loyal to God, my wife and my constituents, and New Yorkers.”

He added that he still planned on caucusing with the G.O.P. when the Legislature comes back into session this month, and said that he had spoken with the Republican majority leader, John J. Flanagan of Long Island, and other Republicans since news of the reunification broke.

Asked if he might join the Democrats after the special elections on April 24, he said he would “consider it at any point.”

But, he said, “I think it’s fair to say that I would have to feel a compelling reason to leave.”

Even before he decided to run for office, Blake Morris had not been shy to criticize his primary opponent: State Senator Simcha Felder. Felder currently represents New York’s 17th Senate District, which includes Midwood, Sunset Park, Kensington, Borough Park and some of Bensonhurst.

Morris, a good-humored, staunchly progressive Democrat, had especially taken issue with the fact that Felder, also a registered Democrat, caucuses with the Republican majority in the New York Senate.

Roughly two years ago, he joined and served as a committee member for NYSD17, a community organization dedicated to electing a true progressive to Felder’s seat. However, the group’s exploratory committee had difficulty finding a primary challenger.



“There’s 325,000 people in this district. 144,000 registered voters, and I couldn’t find a single person,” Morris told Kings County Politics. His lack of success in finding a candidate propelled him to challenge Felder himself.

As a candidate, Morris’ “number one priority” is to “make the state senate Democratic.” He asserts that Felder’s unusual positioning as a Democrat who caucuses with Republicans allows the eight members of the senate’s Independent Democratic Conference (IDC) to vote against their party’s platform.

In response, Majority Leader John Flanagan approves pork barrel projects and stipends for the IDC members. Their relationship buffers Republican dominance in the senate and allows Flanagan to consolidate control over the chamber. ”Take out Felder, and you take out the eight IDC members,” Morris said.

When it comes to policies, Morris focuses on three h’s: housing, healthcare and hope. “Hope is that you’re going to arrive at work on time. Hope that you’re not going to be stranded at a bus stop or subway platform for a bus or train that never arrives,” he said, explaining what he meant by the vaguest word in his platform.

On housing, Morris has suggested a radical approach to improving the quality of living for those citizens reliant on the New York City Housing Authority’s apartment complexes: taxing banks.

Why Is New York Condoning Illiteracy?

Last Friday, as observant Jews hurried with last-minute preparations for Passover, one Orthodox Jew was in Albany, holding up the New York State budget. He was insisting that this roughly $168 billion package include a special provision that would allow religious schools to meet the state’s educational requirements by using their long hours of religious instruction.

In recent years, education activists, among them former Hasidic yeshiva graduates, have pushed aggressively to bring the yeshivas into compliance with the state’s education laws. Simcha Felder, the state senator from Brooklyn who represents the heavily ultra-Orthodox neighborhoods of Borough Park and Midwood, was on a mission to get legal permission for the state to turn a blind eye to the near-absence of secular instruction in many yeshivas. The upshot? Tens of thousands of children would continue to graduate without the most basic skills.

I know about the cost. I was one of those kids.

I was raised in New York’s Hasidic community and educated in its schools. At my yeshiva elementary school, I received robust instruction in Talmudic discourse and Jewish religious law, but not a word about history, geography, science, literature, art or most other subjects required by New York State law. I received rudimentary instruction in English and arithmetic — an afterthought after a long day of religious studies — but by high school, secular studies were dispensed with altogether.

The language of instruction was, for the most part, Yiddish. English, our teachers would remind us, was profane.

During my senior year of high school, a common sight in our study hall was of students learning to sign their names in English, practicing for their marriage license. For many, it was the first time writing their names in anything but Yiddish or Hebrew.

When I was in my 20s, already a father of three, I had no marketable skills, despite 18 years of schooling. I could rely only on an ill-paid position as a teacher of religious studies at the local boys’ yeshiva, which required no special training or certification. As our family grew steadily — birth control, or even basic - education, wasn’t part of the curriculum — my then-wife and I struggled, even with food stamps, Medicaid and Section 8 housing vouchers, which are officially factored into the budgets of many of New York’s Hasidic families.

I remember feeling both shame and anger. Shame for being unable to provide for those who relied on me. Anger at those responsible for educating me who had failed me so colossally.

A woman I know works as a physician at Maimonides Medical Center, in heavily Hasidic Borough Park in Brooklyn, and often sees adult male patients who can barely communicate to her what ails them. “It’s not just that they’re like immigrants, barely able to speak the language,” she told me. “It’s also a lack of knowledge of basic physiology. They can barely name their own body parts.”

This experience — of lacking the most basic knowledge — is one I have come to know well. Ten years ago, at age 33, I left the Hasidic community and sought to make my way in the secular world. At 35, I got my G.E.D., but I never made it to college, relying instead on self-study to fill in my educational gaps. I still live with my educational handicaps.

I now have two sons, ages 16 and 18. I do not have custody of them — I lost it when I left the Hasidic world, and so I have no control over their education. Today, they cannot speak, read or write in English past a second-grade level. (As for my three daughters, their English skills are fine. Girls, not obligated with Torah study, generally receive a decent secular education.)

Like me, my sons will be expected to marry young and raise large families. They too will receive no guidance on how to provide for them and will be forced into low-wage jobs and rely heavily on government support.

They are not alone. Across the state, there are dozens of Hasidic yeshivas, with tens of thousands of students — nearly 60,000 in New York City alone — whose education is being atrociously neglected. These schools receive hundreds of millions of dollars in government funding, through federal programs like Title I and Head Start and state programs like Academic Intervention Services and universal pre-K. For New York City’s yeshivas, $120 million comes from the state-funded, city-run Child Care and Development Block Grant subsidy program: nearly a quarter of the allocation to the entire city.

According to New York State law, nonpublic schools are required to offer a curriculum that is “substantially equivalent” to that of public schools. But when it comes to Hasidic yeshivas, this law has gone unenforced for decades. The result is a community crippled by poverty and a systemic reliance on government funding for virtually all aspects of life.

Men like Mr. Felder, beholden not so much to his Hasidic constituents as much as to their leaders who promise him votes, would like to pretend that this problem doesn’t exist. The leadership of the Hasidic community argues that the issue is exaggerated, an attempt by outsiders to malign their community. They point to outliers, successful entrepreneurs — the Hasidic-owned electronics store B & H Photo Video in New York City is often touted — as examples of success.

But these are rare exceptions.

According to a report by Yaffed, or Young Advocates for Fair Education, an organization that advocates for improved general studies in Hasidic yeshivas, an estimated 59 percent of Hasidic households are poor or near-poor. According to United States Census figures, the all-Hasidic village of Kiryas Joel, an hour north of New York City, is the poorest in the country, with median family income less than $18,000.

One heavily Hasidic district of Brooklyn, South Williamsburg, has, over the last decade, shown dramatic increases in using public income support such as cash assistance, Supplemental Security Income and Medicaid. New York’s Hasidic community is also experiencing explosive growth — surveys show that the Jewish population of the five boroughs has increased for the first time in half a century, entirely because of the high birthrate among the ultra-Orthodox, which only increases the burden on taxpayers.

Knowing all of this, it takes a special kind of audacity on Mr. Felder’s part to successfully strong-arm the state’s highest legislative body to legally deprive his own constituents’ children of an education and a future. Some might call this chutzpah. In Borough Park, it would be more properly called a Chillul Hashem: a desecration of God’s name

Simcha Felder, the rogue state senator who held up the entire state budget last week in a bid to end government oversight of Orthodox yeshiva curricula, just got handed a royal flush.


A reordering of the Albany political calculus on Wednesday made him the most powerful man in New York politics. The surprise dissolution of a breakaway caucus of Senate Democrats leaves Felder as the last piece the Democratic Party needs to consolidate control of the entire state government.

If he wants to make a deal, Felder has a chance to try to extract major concessions from the Democratic leadership in return for rejoining them.

“They’re empowering Simcha more than he was before,” said one Jewish New York political operative. “He’s not going to flip unless they give him a tremendous, tremendous deal.”

In the surprise announcement Wednesday, leaders of the Independent Democratic Caucus said they were ending their alliance with the Republicans and rejoining the mainline Democrats. Felder, a Democrat who has caucused with the Republicans since 2013, is now the last holdout, and a key to the Republicans’ continued control of the chamber.

Felder, who represents a district in the heart of Orthodox Brooklyn, is a much-maligned figure among New York Democrats. The new political reality in Albany won’t make him any more popular, and could bring a wave of unwanted attention to him — and the Orthodox Jewish community.

“It shines a spotlight on Simcha,” said one Democratic Jewish insider. “I do think it leaves him exposed.”

Felder told Spectrum News that he won’t make a decision about joining the Democrats until after two special elections are decided on April 24. The Democrats would need to hold both of the seats to remain within a single seat of the majority. They already control the lower house by a wide margin.

At a press conference about the unification on Wednesday afternoon, Cuomo sought to downplay the importance of wooing Felder to join the Democrats, according to tweets from reporters on the scene.

The governor, who is facing a primary challenge from progressive actress Cynthia Nixon as he hopes to burnish his credentials for a possible White House run in 2020, focused instead on the need to snatch seats away from the Republicans in November. But that could be little more than a head fake to distract attention for a push to get Felder on board and deliver a Democratic majority before the election.

A spokeswoman told the Forward that Felder was on break and not available for interviews. Many Orthodox Jews don’t work the week of Passover.

Felder, a former member of the City Council, is one of the few ultra-Orthodox Jews in elected office in New York. The son of a rabbi, he was known in the City Council for his single-minded campaign against pigeons.

He is said to have few political confidants and is known for relying on his own political instincts.

“He has an internal calculation of what he thinks the right move is and the wrong move is,” the Jewish New York political operative said.

One close advisor is Shiya Ostreicher, a powerful Orthodox lobbyist and a member of the Belz Hasidic community with ties to the ultra-Orthodox umbrella group Agudath Israel. Ostreicher did not respond to a request for comment from the Forward.

It’s unclear what leverage Cuomo and the Senate Democrats could wield over Felder. Felder is seen as politically untouchable in his district, which includes the heavily Orthodox Brooklyn neighborhoods of Boro Park, Flatbush, and Midwood.

Felder does face a Democratic primary challenge from Blake Morris, a progressive neighborhood activist. But he has won election by wide margins in the past, and was not opposed at all in the last two election cycles.

“Simcha doesn’t care,” said one Republican political consultant close to the Orthodox community, arguing that Felder would remain with the Republicans. “Right now he’s very happy with where he is.”

Others say there is plenty that the governor and the Democrats could offer Felder. Despite his best efforts, Felder had to settle last week for a watered-down version of his yeshiva oversight provision last week, after Cuomo’s office called Orthodox leaders to pressure him to relent.

Now, Felder could ask for the full provision, entirely stripping the state education department and local school districts of oversight authority for Orthodox yeshiva curricula, in return for joining the Democrats. Such a deal would likely set off an uproar among Democrats and local activists.

“Simcha Felder will do what’s in the best interest of his constituents,” said Ezra Friedlander, founder and CEO of the Friedlander Group, a political consultancy specializing in ultra-Orthodox clients. “At the top of that list would probably be how yeshivas could be helped.”

If Felder wants to make deal, he’ll need to do it soon. Senate Democrats are hoping to win a handful of GOP-controlled seats in November, feeding off the nationwide anti-Trump energy among the Democratic base. If they do, Felder will lose his value as a swing vote.

“He’s too smart to let that happen,” said one source close to the Senate Democrats. “That’s the problem the Republicans face.”

Last week, Governor Andrew Cuomo picked up the phone and called the spiritual leader of the New York Hasidic village of Kiryas Joel, Satmar Grand Rabbi Aron Teitelbaum, to try to shake a compromise out of a recalcitrant state senator.

According to two people familiar with the negotiations, the call was part of an effort by Cuomo to convince the state senator, Simcha Felder, to compromise on his demand that the state budget end government oversight of the curriculum of Jewish day schools.

The call, part of a broader effort by the governor’s office to reach a compromise on the provision, appears to have worked.

“It came down to, at what point are we going to hold up the entire budget for the entire state of New York and have the entire state blame the Hasidic community,” said one person familiar with the negotiations. “It became too much pressure to bear.”

The version of the yeshiva oversight provision that made it into the budget, which passed over the weekend, has been greeted as a victory by the Hasidic community, but is studded with loopholes that seem to allow the state’s education department to continue to oversee yeshiva curricula.
