Say no to Simcha: Felder cannot take Albany hostage with his demand for letting yeshivas escape state scrutiny

In a move that is shameful even by the low standards of Albany’s budget process, state Sen. Simcha Felder is holding the vast spending package hostage in a desperate attempt to shield yeshivas from state curriculum oversight.

This is as procedurally offensive as it is substantively disgusting. Don’t dare give into the blackmail; better to shut the government down than to let one man pervert public policy like this.


The $168 billion budget is already an elaborate balancing act between downstate and upstate, between Assembly Democrats and Senate Republicans (and Senate Independent Democratic Conference members), between the Legislature and the governor.

After exhaustive — and opaque — deliberations, the Assembly and Senate, says Speaker Carl Heastie, have reached agreement with Gov. Cuomo on the “99.9% of the budget.”

Along comes Felder, an enrolled Brooklyn Democrat who runs on both the Democratic and GOP lines. He is the crucial 32nd vote for the Republican Senate majority; without him, they lose power. Therefore, Majority Leader John Flanagan gives Felder whatever he wants.


So no agreement, no Felder vote. No Felder vote, no deal. Simple as that: down goes the ship.

It would all be gross enough if it were about some tax provision or environmental regulation. But what Felder is trying to do is give supposedly educational institutions free license to stop educating kids.

Yeshivas are Jewish religious schools, some of which serve the ultra-Orthodox community — including many in Felder’s Midwood and Borough Park district.

They are responsible for the education of tens of thousands of young people, and in recent years more and more graduates have come forward to complain of rampant failure by some to teach core subjects: English, math, science, history and more, despite being mandated by law to do so.

The schools properly have wide latitude to imbue young people with Torah, Talmud and other religious instruction. But while under state law they, like all other private and parochial schools, must offer “equivalency of instruction” in the basics, complainants say many students emerge utterly ill-equipped for the real world.

Amidst the rising outcry, the city’s Department of Education supposedly opened an investigation in July 2015 — but has shown little evidence of serious digging, and has given itself repeat extensions. Chancellor Carmen Fariña leaves office with the probe still undone, a black mark on her record.

The city still promises something is forthcoming.

Now Felder is trying to force a rewrite of state law to effectively exempt yeshivas even from these barest requirements by letting them self-certify that they are complying.

In Yiddish, you call what Felder is attempting a shonda.

The Assembly and Cuomo are right to refuse to play his game, and say they won’t pass a budget extender if Flanagan and Senate Republicans don’t go along by today’s afternoon deadline. Which would mean a Senate-caused government shutdown.

They must stand firm.
