If true, this CNN report about Russia could destroy Trump’s presidency.On Wednesday afternoon, an enraged Adam Schiff went on television to lash out at fellow House Intelligence Committee member Devin Nunes, for his handling of the committee’s investigation into Russia’s involvement in the 2016 election. (Earlier that day, Nunes had presented Donald Trump with related information without first briefing other members of the committee.) “There is more than circumstantial evidence now” that the Trump campaign colluded with Russians, Schiff told MSNBC.
We may have a hint of what that non-circumstantial evidence is. On Wednesday evening, CNN published a bombshell—a vague bombshell but a bombshell nonetheless—alleging that the FBI has evidence suggesting coordination between members of the Trump campaign and Russian officials in the release of “information damaging to Hillary Clinton’s campaign.”

While this is a very big deal indeed, the report is thin on actual details and heavily caveated. It is not clear which Trump campaign officials were allegedly speaking to Russian officials (Carter Page, Paul Manafort, Roger Stone, and Michael Flynn are all being investigated). We don’t know the roles the Russian officials held, or even what the damaging information was, though it is presumably the information leaked by Guccifer 2.0, the entity that hacked the Democratic National Committee. It’s also unclear if Trump campaign officials knew they were speaking to Russian officials, or if the campaign was unwittingly infiltrated.

Still, this report looks bad. It suggests that evidence of collusion between the Trump campaign and Russian officials may exist, something that Trump lackeys have been denying for months. And collusion is serious enough that it could bring down this administration. Even a vague report like this is a very bad omen for the future of the Trump presidency.

At the very least, it’s hard not to see this leak as being retaliation for Nunes’s weird and unethical freelancing earlier in the day. Russia is, as Nunes put it, “a big gray cloud” over the administration. This report only makes that cloud bigger and grayer.

Back in June 2017, conservative commentator Rush Limbaugh spent many minutes on his radio show extolling Alan Dershowitz, the renowned defense lawyer and Harvard Law School professor, for taking “100 percent Trumpist” positions on the Trump administration’s legal tangles.

“I don’t know what has happened to Professor Dershowitz,” Limbaugh said of the famed civil libertarian. “But whatever it is, I like it.”

On Wednesday, CNN legal analyst Jeffrey Toobin, who was once a student of Dershowitz’s, offered a similar assessment — only he left out that last part.

Toobin and Dershowitz spent 10 minutes on “Anderson Cooper 360” Wednesday night sparring over the decision to tap a special counsel to investigate Russian interference in the 2016 election.

At times, things got personal. When Dershowitz said it was a “mistake” to appoint Robert S. Mueller III to lead the probe, Toobin lashed out.


“Alan, I don’t know what’s going on with you,” he said of his longtime friend and mentor, arguing a special counsel was necessary.

“How has this come about that in every situation over the past year you have been carrying water for Donald Trump?” he said later in the show. “This is not who you used to be, and you are doing this over and over again in situations that are just obviously rife with conflict of interest. And it’s just like, what’s happened to you?”

Dershowitz parried, saying he’d attacked Trump on a number of other issues, including his proposed travel bans on majority-Muslim countries.

“I’m not carrying his water. I’m saying the exact same thing I’ve said for 50 years. And Jeffrey, you ought to know that, you were my student,” he said. “The fact that it applies to Trump now rather than applying to Bill Clinton is why people like you have turned against me.”

The two widely known legal commentators have gone at it before, but their exchanges haven’t always been this tense.

Last summer, after President Trump fired James B. Comey, Dershowitz argued the novel theory that Trump couldn’t obstruct justice by ousting his FBI director, even if his goal was to shut down the Russia investigation, because hiring (and firing) officers of the government is a constitutional power. “Respectfully, I could not think Alan is more wrong,” Toobin said in a June panel discussion with Dershowitz.

Toobin isn’t the only one who’s questioned Dershowitz’s stances on the probe and its many ramifications. Dershowitz, a lifelong liberal and supporter of Bill and Hillary Clinton, has said that many of his old political allies have shunned him as he has made his case in various television appearances and commentaries over the past year, as The Washington Post’s Fred Barbash reported.


An array of legal scholars have criticized Dershowitz’s arguments about obstruction of justice, including Daniel J. Hemel and Eric A. Posner of the University of Chicago, who wrote that the theory “crumbles under scrutiny.” Dershowitz told The Post in December that almost all of his Harvard colleagues disagree with him, and that those lawyers and scholars who do accept his views are afraid to say so publicly.

“None of my liberal friends invite me to dinner anymore,” he said. “Thanks to Donald Trump, I’ve lost seven pounds. I call it the Donald Trump diet.”

In a column for the Hill on Wednesday, Dershowitz argued that the president was right to say that Mueller never should have been appointed to investigate the “so-called Russia connection.” The decision, he said, “has politicized our justice system beyond repair.” He advocated instead for a nonpartisan commission like the one that investigated the 9/11 terrorist attacks.

Trump cited Dershowitz’s words on Twitter Wednesday (and it wasn’t the first time he’s done so).


In the CNN segment with Toobin, Cooper noted that the president was “very publicly echoing your argument.” Dershowitz defended himself.

“Collusion is not a crime. Obstruction of justice may not be a crime if the president engages in it as part of his constitutional authority,” Dershowitz said. “So I still take the position that it was a mistake to appoint a special counsel, that an investigative commission would have been better. The fact that the president quotes me is not something I control.”

Toobin seemed exasperated. He said appointing Mueller was a necessity because Attorney General Jeff Sessions had campaigned for Trump in 2016. It was mandatory, he said, “if we want to have a legal system that deserves any respect.”

“This is so obviously a conflict of interest,” he said, “and this was the only way to resolve it.”

Strzok-Page text messages recovered for key dates

Newly uncovered text messages between FBI officials Peter Strzok and Lisa Page suggest a possible coordination between high-ranking officials at the Obama White House, CIA, FBI, Justice Department and former Senate Democratic leadership in the early stages of the investigation into alleged collusion between the Trump campaign and Russia, according to GOP congressional investigators on Wednesday.

The investigators say the information provided to Fox News “strongly” suggests coordination between former President Barack Obama’s Chief of Staff Denis McDonough, then-Senate Democratic Leader Harry Reid, and CIA Director John Brennan — which they say would “contradict” the Obama administration’s public stance about its hand in the process.

Page texted Strzok on Aug. 2, 2016, saying: “Make sure you can lawfully protect what you sign. Just thinking about congress, foia, etc. You probably know better than me.”

A text message from Strzok to Page on Aug. 3 described former FBI Deputy Director Andrew McCabe as being concerned with “information control” related to the initial investigation into the Trump campaign. According to a report from the New York Times, Brennan was sent to Capitol Hill around the same time to brief members of Congress on the possibility of election interference.

Days later, on Aug. 8, 2016, Strzok texted Page: “Internal joint cyber cd intel piece for D, scenesetter for McDonough brief, Trainor [head of FBI cyber division] directed all cyber info be pulled. I’d let Bill and Jim hammer it out first, though it would be best for D to have it before the Wed WH session.”

In the texts, “D” referred to FBI Director James Comey, and and “McDonough” referred to Chief of Staff Denis McDonough, the GOP investigators said.

“We are not making conclusions. What we are saying is that the timeline is concerning enough to warrant the appointment of an independent investigator to look at whether or not the Obama White House was involved [in the Trump-Russia investigation],” a GOP congressional source told Fox News.

An FBI spokesman did not immediately respond to Fox News' request for comment.

The congressional investigators pointed out to Fox News that the CIA and FBI are supposed to be “independent agencies,” and noted that “coordination between political actors at the White House and investigators would be inappropriate,” raising questions about the level of involvement of Obama White House officials.

But weeks later, on August 25, 2016, Brennan went to Capitol Hill to brief Harry Reid — and it was unclear whether FBI officials attended the briefing, a congressional source told Fox News.

Two days after the briefing, Reid penned a letter to Comey requesting an investigation into potential collusion between the Trump campaign and Russia.

“The evidence of a direct connection between the Russian government and Donald Trump’s presidential campaign continues to mount and has led Michael Morrell, the former Acting Central Intelligence Director, to call Trump an ‘unwitting agent’ of Russia and the Kremlin,” Reid, a Nevada Democrat, wrote. “The prospect of a hostile government actively seeking to undermine our free and fair elections represents one of the gravest threats to our democracy since the Cold War and it is critical for the Federal Bureau of Investigation to use every resource available to investigate this matter thoroughly and in a timely fashion.”

Reid cited reports in his letter, noting “methods” Russia was using to influence the Trump campaign and “manipulate it as a vehicle for advancing the interests of Russian President Vladimir Putin.”

Reid added that “recent staff changes within the Trump campaign have made clear that the Trump campaign has employed a number of individuals with significant and disturbing ties to Russia and the Kremlin,” urging Comey to make the investigation “public.”

The New York Times first reported on Reid’s letter to Comey on Aug. 29, 2016.

The following day, Aug. 30, 2016, Page texted Strzok: “Here we go,” sending a link to the Times report titled, “Harry Reid Cites Evidence of Russian Tampering in U.S. Vote and seeks FBI inquiry.”

Strzok replied: “D [Comey] said at am brief that Reid called him and told him he would be sending a letter.”

Congressional investigators suggested that the Reid letter possibly provided “cover” for the fact that the FBI and Justice Department had already begun investigating the Trump campaign in mid-July on what they called “questionable ethical and legal grounds.”

“The ‘here we go’ text between Strzok and Page indicates the FBI/ DOJ knew the letter from Reid was coming,” a congressional source told Fox News. “This created the inference they knew it would create public calls for an investigation into Russian interference — covering them.”

The source told Fox News on Wednesday that investigators were neither “passing judgement” nor “claiming a smoking gun,” but suggested that the timeline was “incredibly concerning.”

“At some point, the amount of concerning information becomes enough for a special counsel to look into it.”

The investigators say the information provided to Fox News “strongly” suggests coordination between former President Barack Obama’s Chief of Staff Denis McDonough, then-Senate Democratic Leader Harry Reid, and CIA Director John Brennan — which they say would “contradict” the Obama administration’s public stance about its hand in the process.

Page texted Strzok on Aug. 2, 2016, saying: “Make sure you can lawfully protect what you sign. Just thinking about congress, foia, etc. You probably know better than me.”

A text message from Strzok to Page on Aug. 3 described former FBI Deputy Director Andrew McCabe as being concerned with “information control” related to the initial investigation into the Trump campaign. According to a report from the New York Times, Brennan was sent to Capitol Hill around the same time to brief members of Congress on the possibility of election interference.

Days later, on Aug. 8, 2016, Strzok texted Page: “Internal joint cyber cd intel piece for D, scenesetter for McDonough brief, Trainor [head of FBI cyber division] directed all cyber info be pulled. I’d let Bill and Jim hammer it out first, though it would be best for D to have it before the Wed WH session.”

In the texts, “D” referred to FBI Director James Comey, and and “McDonough” referred to Chief of Staff Denis McDonough, the GOP investigators said.

“We are not making conclusions. What we are saying is that the timeline is concerning enough to warrant the appointment of an independent investigator to look at whether or not the Obama White House was involved [in the Trump-Russia investigation],” a GOP congressional source told Fox News.

An FBI spokesman did not immediately respond to Fox News' request for comment.

The congressional investigators pointed out to Fox News that the CIA and FBI are supposed to be “independent agencies,” and noted that “coordination between political actors at the White House and investigators would be inappropriate,” raising questions about the level of involvement of Obama White House officials.

But weeks later, on August 25, 2016, Brennan went to Capitol Hill to brief Harry Reid — and it was unclear whether FBI officials attended the briefing, a congressional source told Fox News.

Two days after the briefing, Reid penned a letter to Comey requesting an investigation into potential collusion between the Trump campaign and Russia.

“The evidence of a direct connection between the Russian government and Donald Trump’s presidential campaign continues to mount and has led Michael Morrell, the former Acting Central Intelligence Director, to call Trump an ‘unwitting agent’ of Russia and the Kremlin,” Reid, a Nevada Democrat, wrote. “The prospect of a hostile government actively seeking to undermine our free and fair elections represents one of the gravest threats to our democracy since the Cold War and it is critical for the Federal Bureau of Investigation to use every resource available to investigate this matter thoroughly and in a timely fashion.”

Reid cited reports in his letter, noting “methods” Russia was using to influence the Trump campaign and “manipulate it as a vehicle for advancing the interests of Russian President Vladimir Putin.”

Reid added that “recent staff changes within the Trump campaign have made clear that the Trump campaign has employed a number of individuals with significant and disturbing ties to Russia and the Kremlin,” urging Comey to make the investigation “public.”

The following day, Aug. 30, 2016, Page texted Strzok: “Here we go,” sending a link to the Times report titled, “Harry Reid Cites Evidence of Russian Tampering in U.S. Vote and seeks FBI inquiry.”

Strzok replied: “D [Comey] said at am brief that Reid called him and told him he would be sending a letter.”

Congressional investigators suggested that the Reid letter possibly provided “cover” for the fact that the FBI and Justice Department had already begun investigating the Trump campaign in mid-July on what they called “questionable ethical and legal grounds.”

“The ‘here we go’ text between Strzok and Page indicates the FBI/ DOJ knew the letter from Reid was coming,” a congressional source told Fox News. “This created the inference they knew it would create public calls for an investigation into Russian interference — covering them.”

The source told Fox News on Wednesday that investigators were neither “passing judgement” nor “claiming a smoking gun,” but suggested that the timeline was “incredibly concerning.”

“At some point, the amount of concerning information becomes enough for a special counsel to look into it.”
